The Trump administration has petitioned the U.S. Supreme Court to expediently review the legality of tariffs introduced under the 1977 International Emergency Economic Powers Act (IEEPA). This follows an August 29 decision by the Federal Circuit Court of Appeals, which concluded that Trump had overstepped his authority, highlighting that the law had not been previously employed to impose tariffs. The administration is requesting a ruling by September 10 and is seeking to have oral arguments heard in November. These tariffs, integral to Trump's trade and foreign policy initiatives, were designed to address trade deficits and combat drug trafficking, especially concerning China, Canada, and Mexico. Lower courts have determined that the IEEPA does not endow presidents with unlimited tariff-setting powers, referencing the "major questions" doctrine. There are currently at least eight lawsuits challenging these measures, which may significantly impact Trump’s broader economic strategy.
